คำตอบ   กรณีโฉนดที่ดินมีชื่อผู้ถือกรรมสิทธิ์ร่วมกันคือ  แม่ 
พี่ชาย  พี่สาว  และน้องสาว 
รวม  ๔  คน  แม้พี่ชายขาดการติดต่อมาหลายปี  ก็ถอนชื่อพี่ชายออกจากโฉนดที่ดินไม่ได้  แต่หากพี่ชายขาดการติดต่อมานานกว่าห้าปีและไม่รู้แน่ว่ายังมีชีวิตอยู่หรือไม่  ผู้มีส่วนได้เสียหรือพนักงานอัยการสามารถร้องขอต่อศาลสั่งให้พี่ชายเป็นคนสาบสูญได้  เมื่อศาลสั่งให้พี่ชายเป็นคนสาบสูญแล้ว  กฎหมายให้ถือว่าพี่ชายซึ่งเป็นคนสาบสูญถึงแก่ความตาย  ทรัพย์มรดกของพี่ชายย่อมตกทอดแก่ทายาท  ตามมาตรา 
๖๑  มาตรา  ๖๒ 
และมาตรา  ๑๖๐๒  แห่งประมวลกฎหมายแพ่งและพาณิชย์  ทายาทผู้มีสิทธิรับมรดกของผู้สาบสูญย่อมนำโฉนดที่ดิน  คำสั่งศาลที่สั่งให้พี่ชายเป็นคนสาบสูญ 
ทะเบียนบ้านและบัตรประจำตัวประชาชนของผู้ทายาทไปยื่นคำขอรับมรดกของพี่ชายผู้สาบสูญได้
